Customers experiencing gas leaks, electrical hazards, flooding, fire risks, carbon monoxide concerns, or other dangerous conditions should contact emergency responders or applicable utility providers immediately.

Estimates and Pricing Disclaimer

All estimates, proposals, inspections, diagnostics, recommendations, and quoted pricing are preliminary and non-binding unless formally approved in writing or electronically by both the Customer and the Company.

Pricing may change due to:

Hidden or concealed conditions;
Structural limitations;
Code compliance requirements;
Permit requirements;
Inaccessible systems;
Material price increases;
Additional labor requirements;
Manufacturer changes;
Utility conditions;
Previously undiscovered damage.

Repair recommendations are based solely upon conditions reasonably observable and information reasonably available at the time of inspection.

The Company does not warrant that all defects, hazards, failures, or code violations will be identified during any inspection or service visit.

Payment Terms and Billing

Payment is due according to the terms stated on the invoice, approved estimate, financing agreement, or service agreement.

The Company may require deposits or progress payments for certain projects or special-order equipment.

Failure to make timely payment may result in:

Suspension of services;
Cancellation of warranties or maintenance agreements;
Collection activity;
Legal action.

Customer agrees to pay all reasonable collection costs, attorney’s fees, returned payment fees, administrative costs, and applicable interest permitted by law.

Financing Disclaimer

Financing options may be offered through independent third-party financing providers.

Roland Black:

Does not guarantee financing approval;
Does not control lender decisions;
Is not responsible for financing terms, rates, underwriting decisions, or lender actions;
Makes no guarantees regarding promotional financing availability.

Financing agreements are solely between Customer and the applicable financing provider.

Cancellations, Rescheduling, and Refund Policies

The Company reserves the right to charge cancellation, trip, diagnostic, or rescheduling fees where permitted by law.

Custom-ordered materials, completed labor, diagnostic services, permits, and installed equipment may be non-refundable.

Refund determinations are made at the Company’s reasonable discretion unless otherwise required by law.

Customer Responsibilities and Site Access Requirements

Customer agrees to:

Provide safe and unobstructed access to work areas;
Secure pets appropriately;
Maintain active utilities where required;
Disclose known hazards or unsafe conditions;
Remove obstacles preventing service access.

The Company shall not be liable for delays, damages, or inability to complete work resulting from:

Unsafe site conditions;
Structural deficiencies;
Pest infestations;
Hazardous materials;
Hoarding conditions;
Weather exposure;
Inaccessible systems;
Utility interruptions;
Pre-existing damage.

Permits and Code Compliance Disclaimer

are estimates only and are not guarantees.

Actual results depend on numerous variables outside the Company’s control.

Service Delays and Force Majeure

The Company shall not be liable for delays or failures caused by events beyond its reasonable control, including:

Assumption of Risk

Customer acknowledges that HVAC, plumbing, electrical, and generator systems inherently involve risks including:

Water leaks;
Electrical hazards;
Gas leaks;
Structural limitations;
Equipment failures;
Utility interruptions.

Customer voluntarily assumes risks associated with aging infrastructure, concealed defects, improperly maintained systems, and pre-existing conditions.

Indemnification

You agree to defend, indemnify, and hold harmless Roland Black and its affiliates, officers, employees, contractors, and agents from any claims, liabilities, damages, losses, costs, or expenses arising from:

Your misuse of the website or services;
Unsafe property conditions;
Customer instructions;
Unauthorized equipment modifications;
Violations of applicable law;
Breach of these Terms.

Intellectual Property Rights
